Marla Miller Ostrover Wins Summary Judgment in Supreme Court, Queens County

In the case of Kong v. Farazi (index no.: 732887/2025), a pre-discovery motion for summary judgment was filed on behalf of our client, Tanisha Laing.  Ms. Laing was traveling on the westbound Grand Central Parkway when her vehicle was rear ended by the vehicle owned and operated by the co-defendant, Arif Farazi.  Additionally, the vehicle owned and operated by the other co-defendant, Zeghum Abbas, rear ended co-defendant, Arif Farazi’s vehicle. The responding Police Officer cited Arif Farazi’s “following too closely” as an apparent contributing factor of the accident. Judge Robert Caloras of Supreme Court, Queens County issued a decision on September 10, 2026, finding that our submissions on behalf of Ms. Laing established her prima facie entitlement to summary judgment.  The co-defendants could not provide a non-negligent explanation for the accident and their opposition to our motion did not create any triable issues of fact regarding whether they had a non-negligent explanation for the accident.  The Court also found that the plaintiff is entitled to summary judgment on the issue of liability against the co-defendants on the same basis and granted plaintiff’s cross-motion.
