On November 20, 2019, Steven Dyki won summary judgment dismissing the plaintiff’s Labor Law case against our client in Cabrera v. 4219-15 Ave LLC, Index No. 507262/2017 (Sup. Ct. Kings County). The plaintiff claimed that he was injured during the course of his employment at the premises located at 4219 15th Avenue, Brooklyn, New York, when, while walking over beams that made up the framing of flooring on the fourth level of the premises, one of the beams broke and fell, causing the plaintiff to fall from the fourth level to the third level of the building. Before our client was deposed, Mr. Dyki moved to dismiss the case arguing that our client was not the owner, general contractor or agent of either for the project at the premises, and had no other duties in relation to the premises. The Court agreed, and dismissed the plaintiff’s claims against our client.
