Following trial, Riad Hamai prevailed on both the issues of liability and damages in Maguet v. Williams, et al., Index No. 523265/2016. In Maguet, the plaintiff, a front seated passenger within the vehicle operated by our client, sought recovery for personal injuries arising from a motor vehicle accident. The vehicle operated by our client was in the process of reversing off the flatbed of a tow truck when it came into contact with a parked car on the side of the roadway. As a result of the accident, the plaintiff alleged to have sustained injuries to the left knee, left shoulder, neck and back. On March 10, 2020, a Kings County jury returned a unanimous defense verdict finding that our client was not negligent and the jury attributed full liability of the accident to the co-defendant, the tow truck operator. Moreover, the jury returned a unanimous verdict finding that the plaintiff did not sustain a “serious injury” as defined by New York State Insurance Law section 5102(d).
