Following a two day trial, Riad Hamai prevailed in the damages only trial in Fermin-Garcia v. Williams, et al., Index No. TS300017/2019. As the motor vehicle accident involved a rear end collision between our client’s vehicle and the plaintiff’s vehicle, liability was granted in favor of the plaintiff pre-trial. As a result of the accident, the plaintiff alleged to have sustained injuries to the neck, back and disfigurement of his left hand. On February 6, 2020, the jury returned a unanimous defense verdict finding that the plaintiff did not sustain a “serious injury” as defined by New York State Insurance Law section 5102(d).
