On February 20, 2019, Paul Josephs obtained summary judgment dismissing the plaintiff’s complaint in the matter of Balgobin v. Fenner, et al., Index No. 711409/2016 (Sup. Ct., Queens County). The plaintiff claimed that she sustained injuries to shoulder, hip, and knee, as the result of a motor vehicle accident that occurred on July 3, 2016. Mr. Josephs argued that plaintiff failed to meet the “serious injury” threshold of Section 5102(d) of the New York State Insurance Law, that the injuries were minimal and plaintiff was capable of maintaining full employment without any restrictions. The Court granted summary judgment and plaintiff’s complaint was dismissed.
