On December 21, 2022 Paul Josephs obtained summary judgment dismissing the plaintiff’s complaint and all cross-claims against a chimney sweeping company in the matter of AIG Property Casualty Co. a/s/o of Lawrence and Wendy Nadel et al., Index No. 154800/2018 (Sup. Ct., New York County). The plaintiff insurance carrier brought a subrogation claim arising out of a fire that occurred at the home of its insureds causing extensive property damage. It was alleged that the chimney sweeping company was negligent in cleaning the chimney contributing to the cause of the fire. The plaintiff’s complaint and cross claims were dismissed as against the client as the plaintiff and codefendants could not demonstrate that the client’s work was the proximate cause of the fire.
